Denied UI from Employer Didnt give Notice.

Hey,
I am appealing the reason why my employer is trying to deny my UI benifits. I became sick with pnemonia and was unable to do my job and my last employer is using not giving a notice as a reason to block me getting my unemployment check. There are more reasons why I was so stressed that it made me sick. The stresss was brought on my them, not the job. I even went to them and talked to them about my problem that was on their end and they couldn't fix it. (Computer error). I had 90 days to keep up my production, and with the computer problem it just added heat to the fire because it could not be done. Employer said that I was a no show, even though I called out several times and tried to make up time by doing a schedule change. She knew that I was ill.What can I say when I have my hearing? :crying:

    Unfortunately there isn't much you can do since you left voluntarily. Benefits are usually given for loss of a job due to no work, company going out of business, etc.

    Employers may "fight" someone getting UI, but ultimately it's the state agency to determine whether one is entitled to benefits or not. I'm not sure if all states have a similar section, but if one can prove they exhausted all remedies prior to quitting and had "necessitous and compelling reason" to VQ, they might be ruled eligible. It's up to the state to determine what's necessitous and compelling.

    In my case the State went with the corporation, including the appeal.

    Employer put wrong dates on appeal

    I got my last employers paperwork and her reason was that I was a no-show and abandonment. However, the employer put that I was working there in 09-2008 until January 2008. I quit dec 9, 2007 because of unfair treatment, and under the nclabor laws it is not a requirement to give any type of notice, only recommended in case you want to go back to work there.

    Hello,

    I could not do my job because of the computer error that I ws getting and I was on a 90-day trail peroid. I went to them and asked what was wrong with my computer. And they acted like it was not important. So, I waited a couple of weeks and went over my supervisor'e head and even he said that something was wrong. I was so stressed over them not fixing the problem that I became ill. Sick enough to were I could not talk. The employment security commission in my area knows this company well and they were the ones that told me to file the appeal. I have not had my hearing yet. In addtion, I have one more appeal if the state favors with them. I also have all the printouts showing the problems that I was having. I just can't get over their appeal paperwork with the dates being wrong and I ws not employeed past the 90 day mark. Thanks for your information and opinions. But, I did e-mail the labor board and they said no requirements. And this is an "atwill" company.
