Colorado HB 16-1217: another administrative, non-impacting HOA Bill

Here we go again, [URL="http://www.leg.state.co.us/clics/clics2016a/csl.nsf/fsbillcont3/FDA10030B4E961CD87257F2400659933?open&file=1217_01.pdf"][COLOR=#0066cc]HOUSE BILL 16-1217[/COLOR][/URL] is another HOA Bill introduced this session that sounds good, feels good, but will have zero affect on resolving any HOA home owner's issue. This will make it three administrative, un-impacting HOA Bills this session. This Bill will provide: 1) optional rate structures for HOA registration fees and 2) requires the State HOA Office to develop a list of mediators and arbiters who are available to hear complaints concerning elections and other HOA home owner issues. The impact of this Bill on home owners follows:


The State HOA Office is to create lists of folks to HEAR complaints but the Bill PROVIDES NO MEANS OF ACCESSIBLE AND AFFORDABLE[U] BINDING [/U]DISPUTE RESOLUTION: NONE. [U]DORA will not get involved in any enforcement using anyone on these lists (so this changes nothing).[/U] The mediators and arbiters are not required to have any certifications or licenses in HOA law nor will their experience with HOA dispute resolution/law be validated. The main impact will be that one can go to the [U]DORA web site for a list of names that are not, according to this Bill, approved by DORA! [/U]

This Bill [B]implies it is implementing a dispute resolution process[/B]/solution helpful for home owners that was defined in a State Study on this topic two year ago. That State Study recommended the State implement an out of court binding dispute resolution process (similar to how home owners file complaints on HOA Property Managers, no cost to file, DORA investigates, decision rendered, and appropriate fines/license revocation, and no new taxpayer funding to implement!). [B]This Bill has NO ENFORCEMENT OR NOTHING NEW TO OFFER ON ENSURING HOME OWNER'S RIGHTS, NONE! [/B] It will simply create lists of folks you can go to and have your complaint heard (AS YOU CAN NOW and DOESN'T WORK WELL FOR HOME OWNERS); will cost hundreds of dollars at a minimum to have even the most simple complaint heard with no guarantee of a binding decision; will not require any HOA Board to participate; and all conducted in an environment in which there is no oversight, professional rules, or minimum qualifications for those serving as arbiters or mediators.


If you have doubts about what I'm saying read the Bill and correct me as appropriate but it appears HERE WE GO AGAIN with yet another administrative and non-impacting Bill presented as help to home owners.
