Arrested For Driving While Unlicensed and No Tail Light When I Showed Proof Of Both!

Posted 06-15-2009 at 09:39 PM by wardhseena

Earlier today my boyfriend was arrested for driving while unlicensed and no tail light. The initial call seemed wierd because we had his license renewed April 24th, and as far as the light both lights are working. Let me tell you the story. He was at the the traffic light in heavy traffic, the light turned green and the officer turned on his lights, he pulled over. The officer stated he pulled him over for a tail light being out. He asked for his license. the officer then stated that a beige Chrysler had been involved in a crime. "We have a white chrysler pacifica." He proceeded to ask if he could search the vehicle. My boyfriend felt uneasy and asked if asupervisor could be present because the officer said he smelled marijuana and their was clearly no sign of any drug use in a car after its just came from firestone:think:. When the supervisor came, they searched thecar, found no drugs, no weapons, and he had already shown proof of license. Yet I told you that when the officer said something about the vehicle "fitting the discription" he also mentioned a tail light was out. On with the story... After they searched the car they placed him under arrest for driving while unlicensed 40-5-20 state law and no tail light 40-8-23 state law. Officer then stated he couldn't give him a ticket and let him go because he had been served for suspended license. "Yet in April we renewed his license." They impounded the car and took him to jail and they were plain clothed narcotic officers. I was given the run around for hours about locating him and my car. I know that part is'nt unusual but i dont agree with the practice at all. After numerous calls and internet searches i found him and the car. Before he was out of the officer's custody he showed me his license, they are valid until 2011. Please let me know of any advise good or bad you have on our situation. He goesto court next month and i want to be prepared. This was very unfair and out of order.
