Here is another one that has us stumped. This one will probably end up in federal court, which is a real shame as it will strip money away from foster children.

This couple works for the state. The husband is an law enforcement officer and the wife works in a state run hospital. Both are mandated reporters. The husband has arrested several foster care workers for fraud and has investigated the local foster care director for deaths in state's foster care. The wife provides medical care for the state's foster children.

Both are in their late forties. They have spent thousands on infertility treatments and with adoption agencies with ZERO success. They utilized adoption agencies and adoption attorneys with NO success. They waited for a successful adoption situation in excess of FOUR years.

The local foster care director has denied their foster care application for what she calls "trust issues." This appears to be due to the husband's investigations into her department due to deaths of children under her care. Additionally, she stated that the wife has illegal access to medical information to foster children as a result of her job. (medical professional at the local state hospital) Basically, this couple independently confirms all information that the foster care case workers tells them and has caught the foster care system in numerous inaccurate statements. Medical Professionals have a right to medical information to treat patients. As I have stated in previous post, the state's foster care system has been fined numerous times for violations and the state's foster care system continues to deny any wrong doing. The state's foster care system routinely advertise for both foster parents and foster-to-adopt parents.

The state's foster care director states her department will not work with law enforcement personnel. She also states her department will not work medical personnel that will report state foster care failures even if they are state mandated reporters. There is no state law supporting the foster care position, but the director is stating she has "sole authority" to create policies deciding who can foster/adopt from foster care.

unbelievable- no good deed goes unpunished and petty people will do what they can....

Hopefully, the couple can move on and feel good about all the children they have helped. And continue to do so. (It goes without saying, there's probably more to the story.)

Like what?

Decorated cop, been honored for saving multiple peoples lives. Been honored for rooting out government corruption. Wife's a medical professional, again honored for saving multiple peoples lives by her hospital. The couple has provided a mountain of documentation/audio/video recording. Initial discovery with the state, the state foster care attorney did not disputed anything. Not a single document, audio recording or video recording. They just insist they have the "sole right" to determine who they will work with. The state foster system has just decided not to work with cops and medical professionals because as they state they "tattle on us" and the foster care job is incredible difficult and we make the best decisions we can and we have "qualified immunity." It appears the whole mandatory reporter law is meaningless to the foster care system. So what if we violate federal law, allow children to die, and discriminate against couples in the community and falsely advertise. None of that matters, only we know best how to care for foster children. The foster care administrators freely admit to this.

So again, what else is there to say? What else is there to add to the story? People wonder why couples cannot adopt from foster care, this is pretty cut and dry and their is both audio and video documentation to document the problems.

This is pretty much a national problem.

My understanding that U.S. District Judge Janis Graham Jack is threatening to find Texas Foster Care officials in contempt of court again because they refuse to comply with her court orders after finding them in violations of federal laws.

We wanted to release to the public the depositions that were taken in the settlement hearing, but the state's insurance carrier has offered a settlement and the settlement includes a gag order. So we will not be releasing the transcripts of the meeting.

It does make me wonder if we have a member of the our State's foster care organization monitoring this group. The settlement is large enough to allow the couple to pursue surrogacy. I think that is great for this couple. Unfortunately, it does not help any of the children trapped in foster care.
