He is 10 he receives survivors benefit so I am wondering if we change his last name will it end it. Because we were told adopting him will end it. The only thing about that is I am seeing different information on the subject after researching. I don't know which is correct. I am located in NJ. We will contact SS again on this but its the weekend so their closed. A phone call to them can take forever... Anyone experience this or work for SS that can help me thanks

Talk to a lawyer. Its a better option than asking for advice on an internet forum.

I agree with Mark.

However:

https://consideringadoption.com/adop...y-and-adoption

"Can Adopted Children Receive Social Security Benefits from their Birth Parents?

You would typically only be eligible to receive social security benefits from your birth parents if you were adopted as result of their death and you received survivor benefits. In adoptions where your birth parents are living but have terminated their legal parental rights to you, you are no longer legally connected. Therefore, you’re not legally eligible to receive their social security benefits, unlike your adoptive parents."

I agree that you should contact an attorney at least for a consult. I wish I knew someone in Union that I could recommend. I'm in South Jersey now but originally from Union County. I can tell you a great dentist on Chestnut Street lol We drove over an hour just to see him.

See an attorney. Too much is at stake to not seek qualified legal advice.

Absolutely, you need a good attorney to not make a financial mistake.
Even without a name change & formal adoption, you can add your stepson as a beneficiary to your life insurance & to your will to insure he is provided for. This would demonstrate to him that you consider him a son.
