I live in Ga., but I am trying to find out some information for my husband's Uncle. We are helping him prepare his will and Living will this weekend. He was told that his children will have to pay $250 for every $1000 that their portion of the land is worth. Is this true in Alabama?

I'm no expert on inheritance law, but my gut tells me that is almost certainly false, unless he's factoring in Federal inheritance taxes and the whatnot on a very large parcel. I would find a good tax attorney pronto. Might be worth the investment if the estate is large enough.

Definitely talk to an estate planning attorney. An option might be to put the estate into a family trust to avoid the inheritance tax altogether.

I found this info about inheritance tax. It appears at this time there is no inheritance tax in AL.

You do need a lawyer however to find out how to handle probate court in this state.

Default Inheritance Tax

It's been a while since I was involved in this subject, but as I recall, there is no inheritance tax in Alabama. The Federal inheritance tax is based on the total value of the deceased's assets and doesn't kick in until several million dollars. Unless recently changed, there is no State requirement to probate the Will and certainly no benefit in so doing other than enriching the Attorney involved. As already advised the party involved is cautioned to consult a tax Attorney . It is also advised to be careful of Attorney fees-be sure to know the absolute total of what will be charges and shop around. This is not a complex issue and fees can vary greatly. Don't get ripped off.
