The state owns the subsurface mineral rights on private land . part of the owner state. does the permanent fund ring a bell. This stuff is part of the owner state.
The piece of property I own by Anchor Point is surrounded by state and CIRI (native land) this is where I worry they will drill. They would not bother drilling on my 10 acres when there is hundred of acres of state land to drill on. Remember the state likes to drill for oil.

If you do not own the mineral rights, there would have been documentation about severed mineral interests when you purchased the land. Mineral rights are dominant to surface rights. The surface rights owner will never win in court. Personally, I would never be interested in purchasing property without mineral rights. You have zero control should the mineral rights owner want to explore.

It is very difficult, almost impossible to purchase land anymore in Alaska with the mineral rights. As has been mentioned on this thread very few people have mineral rights and the few that do have those rights rarely sell them.

If someone wants to access the minerals under a property, (in Alaska that is generally oil and gas which they can usually access from off the property), a judge will try to find a way to access those rights without disturbing the surface rights.

thanks guys, I appreciate the feedback. One thing though...a lot of people answered that I don't own the mineral rights. That is fine. What I am worried about are my surface rights. The companies coming on my land and ripping it up.

I actually put on my permit approval that I wanted pathes put in so the moose could travel easier through the dead beetle killed trees. So far saexploration is on hold for now.

The drilling they do for seismic consists of a small drilling unit dropped in with a chopper or towed behind a snowmachine. They drill usually no deeper than 25'. Any actual drilling for oil or gas could be a year or more down the road. Processing of seismic data, planning and permitting all takes time. And with todays technology, they can build one small pad and drill numerous wells in multiple directions keeping the environmental impact to a minimum.
