Let's see"
The Katie John case,
A dual view case of subsidence rights and State sovereign rights to regulate fish and game granted by congress in the state hood act. Case was abandoned by Gov. Tony Knowles (D) during a re election bid seeming to try and gain the Native vote. IMHO
http://media.adn.com/smedia/2008/09/...ffiliate.7.pdf
Maybe someone else will have luck finding the other two cases mentioned. I am sure they exist, goggle, 9th circuit court of appeals, and AK state courts searches of the web sites reveal nothing. Other searches reveal biased bloggs.
One last thing, I fully support the subsistence lifestyle in Alaska by any one wishing to eek out that kind of existence. I only have one proviso which is use only pre white man tools, methods, etc. Enhancing traditional skills and lifestyle. So send all your guns, boats and motors, ATV, cars, trucks, propane, gasoline, diesel, plywood, tin, food stamps, rope, modern fishing nets, freezers, etc. to Carslile trucking in Fairbanks in care of Arcticthaw and I will arrange pick up.
I am not trying to sound mean or anything, just that subsistence is being abused by those not living where they claim subsistence. If you travel by commercial carrier to subsist, you don't need it, cause you don't live it. Might be part of the cause of apparent over harvesting in some remote areas.
"Many of our relatives are going to want their traditional
foods for next winter but it is going to be very hard for us living out here to
harvest what we need for ourselves, not to mention our relatives in urban
Alaska. Fuel costs are very high and it will costs hundreds of dollars more for us to
go Subsistence fishing, hunting, and gathering this year. If our urban relatives
come out for a visit they need to bring cash for gas, and a few cases of food stuff
from Costco, fishing tackle, nets, and ammo for hunting to help out in getting our
food for everybody."
