Marble Brewing and Marble City are two different names. Its like saying Budweiser and Budvar are the same.
There is totally such thing as a Beer Snob and from that article and what I have been told they are it.

If it was your business that had a trademark infrigment , I believe you would view that differently.

Here's another way to look at it.
If your local guy wanted to start up Duke City Brewing, and somebody out in North Carolina already had an established Duke Brewing, and threatened trademark infringement, who would you support?
In any case, it sounds like they may have worked out a deal where the Marble City name, limited to the state of Tennessee only, is allowable for an undisclosed settlement.

There was a major trademark dispute between Budweiser and Budvar. For a while you could get Budvar in the States under the name 'Crystal'.
The thing that sticks in my craw was that Marble was selling in New Mexico and Arizona. Then after the whole trademark infringement lawsuit was made, they sent a few cases to a liquor store in Knoxville so that they could say that they had an 'established marque' in the Knoxville market.
Legal? Yes.
Ethical? Dubious.
Douchey? ...

It is encouraging to see new microbreweries starting up. I've tasted some really bad "Craft" beer and made some that I should have thrown away (think Persimmon beer). It seems that there are local tastes that influence the style choices that breweries make in their production. I hope there is sufficient diversity in tastes to keep things interesting.
I was a city planner for a while and it is hard to get a new brewery open in some places. Zoning regulations dictate where a brewery can be located since it is considered a manufacturing operation. In some places they are limited in the amount of production thay can have or they are required to sell a high percentage of food requiring an added investment in a kitchen. I don't know what the requirements are in Albuquerque but they seem to be flexible enough to allow new breweries, which is great.

Two completely different names. Read what I said. Either way I think its bad practice and wouldnt hand my money over to them.
On a side note I am drinking my Irish Ale (Northern Brewer Kit) and it is to DIE for. Shes been sitting a year in the bottle and tastes fantastic!

No, they're not completely different names. Marble Brewery and Slate City Brewery would be completely different.
This would be like someone starting a brewery and calling it Samuel Adam's Tavern Beer. Changing or adding one word doesn't get you around the trademark.

The other thing you have to consider is that Marble may have ambitions of expanding nationally. If they don't challenge it now, they can't challenge it 20 years from now.
They remind me of a brewery from KC called Boulevard. 20 years ago, they were only in KC. Now they're all over the midwest. In another 10 years, they might be national.

The owner of Marble is a very, very wealthy person with interests in other parts of the country. I wouldn't doubt if it is in his plans or whatever his continuation plan is for after he passes to go nationwide with it.

Well to me they are, and IMHO does not warrant a court case.
Good thing as a consumer I can complain with my hard earned $$$ and not spend any money there  Which I will do anyway considering what I know of the Master Brewer.
