No, I just think it's ridiculous. It's not like they're going up against the Gestapo or anything. There's no green chile police in New Mexico. They wouldn't be slapped with fines if they didn't offer green chile on their hamburgers.
But as has already been said, there's no telling why In-N-Out passed over New Mexico as part of its expansion. Your "research" notwithstanding, of course.

ITHINK In-N-Out passed over Albq for now because Albuquerque is isolated. Unlike other cities Albq does not have huge cities surrounding it. Witch is good though. I like being able to drive in either direction out of Albuquerque in be in the country. City life can be very stressful.
For the record, Five Guys does NOT offer green chile on their burgers and they seem to be doing fine here in ABQ. If you want green chile on a burger, they're are plenty of good local restaurants/chains where you can get some. As for In-N-Out, they're corporate office has stated in the past that NM would in fact be part of their future expansion, but no timeline was given. I'm sure when they have a distribution center (DC) close enough, we'll see them enter the market as In-N-Out never freezes their beef, locations must be within 6 hour (or so) drive from a DC. ABQ nor the entire state of NM has a population large enough to support a DC at this time, which is why they skipped over us and opened in the DFW market. That being said, they did open several locations in the SLC market, so maybe we are already within the needed distance, and they'll come sooner than later.

A flight from SLC to ABQ is the only way to get something here in less than 6 hours. A drive on a semi, which is how they would transport the beef, would take far longer than 6 hours.
There are a lot of people here that find "no green chile" in a restaurant to be a deal breaker, so to speak. That's their problem.
To be completely honest, I don't think IN-N-Out is letting green chile stand in their way. I believe they are more preoccupied with expanding throughout Dallas, and possibly other parts of Texas before they consider NM. Furthermore, I expect to see them open a location in El Paso before anywhere near ABQ. El Paso would be a good choice, but I'm not sure how far that city is from wherever their distribution center is at.
IMO, In-N-Out burgers stand on their own and are delicious without green chile.
5 Guys, on the other hand, could sure use it (kinda like Sonic etc).
