When the housing slump started, many builders added a clause to their contracts requiring you to occupy your house for at least a year before selling it. I signed that myself - in April 2007. I don't know if there were any consequences for lying...

It is related because the builders may still do it, should he be interested in new construction.

No, the person asked a specific question about a specific piece of nonsense his/her coworker told them. Unrelated to new or old construction - just a question about residency and investment properties. So...irrelevant to the o/p's question.
