I wasn't sure when it was or is supposed to be.

Ok, never mind that question, I looked at the HSV POA web site and found that it passed.

But what exactly is the new POA monthly fee? (for a single family home, not a condo...I know they have separate and additional fees) A person on a budget like mine really has to take that into account when considering whether they can afford to buy a home there.

Currently the POA is collecting $37.52 per month, whether the lot is improved or not. At some point, probably when the lawsuit is settled, improved lots will go to $65.00 per month and unimproved will revert to $36.68 per month. Unclear is whether the POA will collect/refund the undercharge/overcharge since 01/01/2015 (the effective date of the increase).

That's quite a jump, but I can understand why it would be necessary....HSV is very clean and well-kept and provides and maintains a lot of amenities, and that takes plenty of money! It would be well worth it to me to be able to live in a place where no one would be able to pile junk on their porch and under their carport, nor collect junk cars in their yard, nor let weeds and grass grow waist high, fill their back yard with constantly barking dogs,etc. With my budget, though, $65/month could be quite a weighty factor in deciding whether I could afford to live there or not, especially if I wanted to live in a condo.

Why is there a lawsuit going on? I saw the numbers and it looked like it passed by about 60/40.

It only takes 1 unhappy person to sue. There are a number of claims made, most important claim is that a two-tier system is not allowed by the Declaration.

Well, I haven't given it a whole lot of thought, but at first thought it seems as if a one-tier system is not fair....people who only own a scrubby, unimproved lot paying the same amount as someone who lives there full time in a million-dollar home? I assume the Declaration can be changed.

I don't know, what is your take on that?

I really, really would love to come back to HSV and just spend a whole day or two exploring all the different neighborhoods, look at some of the cute homes I've seen on the internet....all I got to see was DeSoto Blvd. from west gate to east gate and Castellon Courts condo complex (which is really nice). We didn't have enough time to do all the other things we wanted to do and that too.

the Declaration can be changed by membership vote every 7 years. It was last changed in 2013 (effective 2014), so it can't be changed again until 2020.
