I have a 2 yr signed lease with 6 1/2 months left on lease.
Contract states "Landlord and its agents shall further have the right to exhibit the premises and to display the usual "for sale", "for rent" or "vacancy" signs on the Premises at any time withing forty-five (45) days before the expiration of this lease".
It is currently 180+ days prior to lease exp. and he just posted for sale signs in the yard and realtor is demanding access to show house, photograph house, etc. Is he in breach of contract? Can I refuse entry for purpose of exhibiting home until 45 days prior to lease exp per the lease contract? Two additional details -- I have a dog in the house. I also work from home and can't be disturbed while working. Can I demand "quiet enjoyment" until 45 days prior to lease exp?
(Background info) Landlord has been fair until this point, I've paid rent on time w/o fail, etc. I don't want to move until lease is up, and I want to enjoy my privacy until 45 days prior to exp as contract states.
He offered compensation contingent on home selling w/in 6 months -- but he is asking $75k above appraisal. If house doesn't sell prior to lease exp. then I've forfeited months of privacy & quiet enjoyment with no compensation. He's also threatened to show the place anyhow and just call the showing an "inspection" instead of a house "exhibit". Any advice would be appreciated. Residence is in Georgia.

What does your lease say about inspections? If he showed his hand as inspections being the route he might take, then see what the rules are there.

Sounds like your landlord is calling your bluff and banking on you not doing much to interfere. With that attitude, any compensation he agrees to give you should be in writing. And I wouldn't make it contingent on a sale - as you have noted, his price is unreasonable and the intrusion on your rights is certainly NOT contingent!

If he tries the inspection route, then presumably it will be potential buyers or agents coming in - not plumbers, etc. In that case, you could certainly interact with the buyer or agent by letting them know you have a valid lease, etc. My guess is that will impact the chances of those buyers pursuing the house. I wouldn't suggest escalating the matter or being hysterical - your valid concern would be minimalized by your overly zealous actions.

This. For example, is there a limit to the number of inspections or an inspection schedule (it is usually quarterly). Then when he/she comes in for the inspection, just leave the place a total mess to the point where buyers have to step over clothes and dishes all over the place. And make sure you are there...in your house robe. LOL. He won't be back.

Would it be feasible to simply explain you have a dog that could be dangerous around strangers (just make it up) and you work from home and need to avoid disturbance or else you could lose money affecting your ability to pay the rent (just make it up)? That might get his/her attention.

If he does show up to "inspect" with potential buyers, be sure to have your list of things to be fixed. I might be sure a toilet is clogged just for show.
