An attorney isn't going to take a case where the only thing the plaintiff is entitled to is a few hundred dollars in out-of-pocket expenses. They will tell them to take it to small claims.

I am surprised lawyers weren't ringing your phone off the hook from the get go. Contact Clark Howard or the FOX 5 I-Team (or whatever they are called). Ask the police dept. who took the accident report who to contact. Surely, you know how difficult it is to get a phone call answered in every branch of gov't so maybe it's time to get in your newly fixed car, head down there (wherever there is), and do a face-fo-face. I am not clear exactly what the hesitation is or the circumstances are, but I have never had an accident where my insurance company was unwilling to follow up with the other party.

I have only heard of someone fighting in court over a couple hundred dollars in family law / divorce cases.

At this point they won't win a medical pain/suffering claim unless they were under a doctors care for injury related to the accident within a week of it. I would think that if the OP were trying to get pain and suffering, they would ahve already been represented by an attorney.

Perhaps you aren't aware of small claims court. The entire point is that you don't need an attorney. Both parties come in and state their case, the judge decides who owes how much to whom, and that's it. No jury, the entire process is usually over in under five minutes. I've taken two people to small claims court, both times for amounts of under $1000. I've won both times. The key is to have your documentation in order--any paperwork, photos, witnesses. Some courts require witnesses to appear in person, they can not submit a signed statement unless it's part of a police report/investigation.
