I am not a certified lawyer, but MARTA can just use the catch-all (taken from their Ride with Respect pamphlet under "Conduct/Civility"):

"i. Any other behavior that hinders the comfortable use of transit facilities is prohibited."

So if MARTA customers start complaining about arjay's ashes to MARTA Police, arguing that it "hinders comfortable use of the system", there could be a problem. Of course, I don't think they'd sue because they don't need the negative PR that would come from waging a legal battle for that reason (MARTA wasting taxpayer dollars to fight a legal battle against some guy who spread ashes on MARTA property, apparently at the wish of the cremated individual).
