Last year, when we secured our rental, we dealt directly with the landlord's agent and we agreed to let her represent us for a period of 1 year. We knew at the time it was merely a formality so she could get the full commission and did not care.

Now there is a big big big problem with the house we are renting and we reported it to the out of state landlord and he contacted his agent who is his local contact.

As I have previously posted, our landlord has decided to sell this house at the end of the lease and this big big big problem comes on the eve of the listing.

His agent (and our buyer's agent) informed me that when she entered into the listing agreement with our landlord 2 weeks ago, they also purchased a home warranty. She wanted us to sit on the problem and wait until she got the policy information in so they could then make a warranty claim to fix the house.

I don't believe her and I feel she was going to help her client buy a policy after this problem arose and stick it to the warranty folks.

We now want to move ASAP and negotiate a home purchase on our own or with another agent and we want to sever that agreement a month early. This whole warranty thing is super slimy.

I'm not licensed to practice law in Texas (yet) and am not familiar with such terminations. Anyone got any ideas.

Looks like I found my answer. There is a termination form at the TAR website and i've adapted it for my use. I hope the agent does not get difficult tomorrow when I ask her to sign it. I'd hate to discuss fraud allegations. These things can get so messy.
