What is the name of your state (only U.S. law)? Texas

Hi, me and 2 others got a ticket last month for going 46 in a 40. He pulled all of us over at once.

I was offered deferred disposition last year in May of 2010 and was required to take DD along with it to get it off my record. I did that the following month.

For this ticket, am I still elligible for Deferred? I know if youre under 25, Deferred requires you take DD to get it off your record. But since I took DD as PART of Deferred in a different city last year, can I still do this?


-My question is basically, since I took DD 9 months ago as PART of a Deferred program, not for the Defensive Driving program in general. Am I still elligible to take it again with Deferred? I don't mind paying whatever, as long as its off my record. I shouldn't have been going with the flow of traffic, but instead the speed limit posted.

-And is there a way I can check to see if DD was even put on my record? Come to think of it, I dont remember actually giving them my certificate.

I'm just trying not to have points on my record. My insurance is already high because I'm so young.

You can only use DD to dismiss a ticket once every 12 months. So, no.

Not quite true.

When you are awarded deferred adjudication, there are explicit stipulations that you must meet. Now I don't know if it's the same now as back when I was, uh, a bit more enthusiastic with my driving, but how it worked with me was that even if you had taken DD you could get DA and that would allow you to take DD again even if it's been less than 12 months. The terms of the DA was that I could not get another ticket for a 6 month period. So with DD and not getting a ticket, if I stayed clean for 6 months then I was cool.

So when you do the math you realize that in theory you could take DD 3 times a year when you factor in the original infraction plus 2 6 month DA's.

Again you have to check on the terms that you agreed to when you first got the DA as that will spell out exactly what you can do for a given time period.

BTW, I don't know how age factors into this as all of this was when I was way older than 25

True, you can only take a Texas Defensive Driving Course once every 12 months. The interesting thing here is that you are under 25 and most courts pretty much do whatever they want when it comes to allowing these courses. It's best to check with your court and get a ruling from them. Also, it never hurts to take a Texas Drivers Safety Course . Lots of people learn better driving techniques.
