The Yazdi's don't park in their driveway. They always park on the street, so the kid wasn't even on Yadzi's property if he was under the car. He was on the public street. Don't think that castle law covers the street.

People are assuming that he was under the car based in what the killer or the killer's wife is stating. Of course they're going to try to imply this is hopes that it may validate shooting. Crazy. I know people who know Enrique (the victim) closely - they all highly regard him and say that he was the nicest guy they ever met. Enrique had already called a friend for assistance and was waiting at the intersection. Unfortunately, by the time his friend arrived - sounds like within 10 minutes, the emergency responders were working in Enrique trying to save his life.
I also know people are familiar with the killer. There has been prior incidences involving him and guns and being very threatening in general.

Good point. I don't know either party involved, but clearly the entire story isn't being presented. Why would someone who got into an accident walk/run to house and hide underneath a car? It makes no sense at all.

Correct, unless Yazdi is a CHL holder - in which case it covers wherever he is (if he feels like his or someone else's life was in mortal danger).

But from the afidavit, it appears there was no threat to himself or anyone else.

A very good lawyer might be able to get him off, but it sure looks like a bad shoot.

Everything points to the young man being a very good upstanding kid with a good future in front of him. If it is a bad shoot which looks like it was with the information we currently have, I hope his family is able to get any reasonable financial retribution for the shooters assets.

I don't believe the Castle Doctrine is 'expanded' for CHL holders. CHL holders can CARRY a concealed weapon many places other than home and vehicle; but pulling the trigger isn't affected by carry-status.

Maybe he was feeling a little dizzy after crashing his car and wanted to lay down. Perhaps it appeared as though he was lying under the shooter's car. Either way, if he was doing something to the car, illegal or not, that doesn't give you carte blanche to shoot them or attack in any way. The only way I can see you getting away with shooting someone stealing your car, is if they were about to run you over with it.

The police sure charged him pretty quickly with murder, which means they have a lot of solid evidence against him.

Interesting laws you have in Texas, so if a person comes on to your property at any time you have the right to shoot him/her if you perceive that there may just be a chance he will commit a crime against you or your property ?

Is there any lower age where one cannot shoot a person ? for example a six year old who has taken a nail from your garage and is fleeing with your property ?

The guy was arrested and charged with murder. What are you getting at?
