I would hope Realtors disclose to their clients the HOAs which have adopted this "priority of payment" resolution. Most folks wouldn't know to ask or expect such a thing because it is outrageously unbelievable. Buyers would certainly want to be aware of such a "resolution" long before the closing table given the risk it represents to their investment and the environment they will be subjected to in such a subdivision.

If people knew they would avoid the place like the plague. So it's not about improving property values for the owners of the property. It's about extracting value from the owner's property for the benefit of other parties.

A buyer should have heightened scrutiny with respect to investing a dime in any subdivision managed by Alliance Association Management because this resolution tends to be particularly prevalent locally wherever that organization goes.

Given that we cannot count on real estate professionals to advise prospective purchasers of this scam, perhaps someone should post the results of searching the county clerk's office in Travis, Hays, and Williamson counties. Prospective purchasers might want to know about all the subdivisions that have implemented this scam before investing a dime there. Surely we can all agree that such knowledge would certainly make housing that is not burdened with private fining or the priority of payment scam considerably more desirable and thus more marketable.

I am going to have to look into this a bit more, just to see some history and take a look to see if there are any fundamental differences in the 'affected' HOAs. I have a gut feeling that a 'simple' fix can be made, if necessary, in the form of an amendment to the covenants. I also am quite confident that the current board/residents would not have problems with the idea. There are plenty of lawyers of various backgrounds that I am sure that a simple limitation could be added that would prevent the worst of those injustices, and seeing as the management company has not vote in the matter, I am not too worried about thier influence. As I said, though, it will take a little research into, then decide what needs/should be done.
