Default Question for someone about custody

My sister in law is most likely going to be going through a divorce. They have a small child together and she wants out of El Paso. She is concerned that the courts will make her stay in El Paso until her son is 18 (he is 4 now). She would like to move to Austin to live near family. Does anyone have any experience on what could happen?

Nobody has any experience with this? shocking. I understand each situation is different I was just trying to figure out the norm in Texas.

There are no "norms". It's all about what the other party wants to fight about. If the father demands the child stay close to El Paso, the courts are allowed to consider it. If your sister can show a family support system in place elsewhere and a JOB elsewhere, the courts will also consider that too.

I've had friends that went through a divorce and couldn't move out of state... but that was in Florida and SC. I've never heard that you couldn't move out of a city though...

The courts can and will limit her to a certain location if it is asked for. In my divorce 14 years ago I was limited to Travis County.

thanks, Ugh, she really doesn't want to be trapped in El Paso for the next 14 years.... They are both Dr's so financial means can't be claimed. Hopefully she will be able to find a really good lawyer.
