Hi,

I needed a car of different color, and the dealership promised to bring it over from their other location. I've signed a simple one-page paper with a dealership basically saying "I agree to purchase this car from you," and paid first lease payment. It was just so they can protect themselves, so that they wouldn't pay for the transfer and I would bail, which I understand.

They were supposed to bring a car from their other dealership for me to lease within a week, but it's been two - they already sold one that they brought - and now of course since they have me on the hook, they're in no rush. They ignore me or just give excuses.

There is no date by which they have to bring a car. I haven't signed a lease or anything else. The dealership is legit, one of the biggest in the city, and best reviewed on Yelp which is why I trusted them.

Question is, can I get out of this and get my money back, and go to a different dealer? Or can they keep this up indefinitely?

You're asking a legal question that should only be answered by an attorney who is familiar with all of the terms and language of the contract.

Why don't you go into the dealership and ask? Why would you every sign anything without a given date?

My "Non-Legal" guess would be YES, John . . .

Sure sounds like the dealer has not performed with a reasonable delivery time.

SJ's advice is very logical and may save a great deal of grief for both sides.

Good Luck

Does "this car" include a vin/stock number/any unique info? If so it would seem they are the ones in breach of said contract if that car was sold to someone else.

OP, has the dealer breached the terms of your contract by not delivering within the agreed period?

Legal information is NOT legal advice, understand the difference.

Literally no one can answer this in any meaningful fashion without knowing exactly the text of the agreement says.

Asking "can I get out of this contract I signed" is most assuredly asking for legal advice.

If you have the time, you could file all the permits and picket them. You need to only state the facts and/or clearly label your opinions as just your opinion.

That might work even if the contract is "airtight".
