doubtful, the law only talks about holding the phone, not about using it.

I believe in California, even holding a dead phone is all it takes. I recall reading that people prefer not to use phone based GPS in california for this reason.

You do realize with your phone active it's technically in use? Doesn't matter if you were or weren't texting ,talking or on the web. Your phone was in use by sheer definition.
I carry a silly device on my wrist called a watch. Amazing how they come in handy.

According to this: http://ottawacitizen.com/news/local-...-and-what-isnt, not only is there a $490 fine, but 3 points on your license.

By the way, this law has been in effect since 2013, so it's really no excuse for you to say you didn't know about it. Put your phone away while you're driving (even at stop lights)! Please don't kill me or someone I care about.

Have you set the clock in your car yet? Did you know there are widgets that allow you to have a clock on your lock screen?
Will you use this same story the next time you're unjustly ticketed for simply 'checking the time on your phone'?

It's doubtful that you can get the fine reduced. It's your word against the cop's. If you tell the judge the story you told us, then you'll be paying the full amount.

Set the correct time in your car.

Buy a watch.

Put the phone in your trunk.

Far too many people are being killed and injured by people messing with their phones while behind the wheel.
