Hi all,

I have a product that i will likely be hiring a to be determined company to build a prototype for me. I have a few items i am planning on doing beforehand to protect myself and the product, but wanted to get your thoughts/ideas/experience. Here is what i have planned:

- Provisional patent
- NDA agreement with protyping firm before discussions

I have done provisional patents before with attorneys, so i understand the patent process, cost, etc. But these were for tech products/services, not physical devices such as my latest. I have also done simple NDA's in the past.

What else should i be doing? What i am i forgetting/missing?

When it comes to these things you are never really totally protected unless you are in a locked room in-which you are the only one accessing it.

You can do nondisclosures with everyone who has or will have access to your intellectual property. You can do the patent path which is not cheap.

I have heard of people documenting everything and mailing it certified US back to themselves with date stamps to protect themselves.

I have done prototyping for several customers (CNC laser work) and only once had to actually sign a non-disclosure agreement. In two cases, I ended up getting the contract to manufacture parts of the product, as many as 2,000 at a time over many years, still without non-disclosure. Their confidence comes from not having one company make all of the parts, and they have their own staff do the final assembly.
