What if I don't get a patent before I sell a product? Can a company get a patent on an idea that has been sold by someone else?

1. Generally the sale of a product before you get a patent will prevent you from getting a patent on your idea. Solution: Always get a patent first!

2. No. See point number 1 above and you can only get a patent on an idea that you yourself invent. You can not get a patent on an idea or product that other people have created.
