Default Failed background check on rental app.

Situation: residential rental application requires HOA approval. Property owner has allowed tenants to move in without approval.

Background screening report of one applicant revealed that the SS # given was not a match. No credit history was discovered, although applicant states he is a business owner for 5+ years. Have copy of DL, but that did not match. No criminal record came up. Applicant is not a citizen of the US.

Due to staff turnover, HOA response not timely, so believe that approval may have been given by default.

What steps would/should you take?

sounds like the HOA needs to consult a attorney.
