If it were illegal, a lot of second-hand places would be shut down. Half Price Books for instance resells used DVDs and CDs.

You can resell original cd's, dvds etc, you cant sell copied/reproduced ones. Furthermore, to be legal, the seller can not keep copies of what was sold in their collection because you give up your right to have a copy with the sale.
Example: You can copy a dvd and play the copied edition to protect the original from getting scratched, but if you sell the original, the copied one must be destroyed in order to comply with the law.

Re-selling is pretty much protected by the Constitution. By consensus, some items like medicines are not resold, but one of the biggest reasons for the Constitution was to prevent and eliminate state laws that prevented free trade or imposed punitive tariffs on interstate commerce.

texdav, you misinterpret. It is consensus because technically any laws abridging the right would not hold up in a true and fair Constitutional fight. There are any number of laws that are unconstitutional. The Jim Crow laws were unconstitutional but existed for many years. Those were also laws of consensus. I simply refuse to buy into the mentality that just because something is a law, that law is legal. I choose my battles and wouldn't resell meds because of personal beliefs, but I also know that giving away rights is a stupid way to live that only gives power to bullies and jerks.
