"SB 435, also known as the Motorcycle Anti-Tampering Act, gives law enforcement officials the ability to cite noise pollution violations under the California Vehicle Code, reinforcing a 27-year-old federal regulation that is rarely enforced.

Under the proposed law, motorcyclists pulled over for other traffic violations could also be cited for illegally noisy exhaust pipes and fined $50 to $100 for a first violation -- a fix-it ticket that could be dismissed with a proof of correction. Subsequent offenses would result in fines of $100 to $250. The bill, which has also passed the Assembly, is headed for Gov. Arnold Schwarzenegger to sign. It would apply to motorcycles and after-market parts from the 2013 model year forward."

"According to the Air Resources Board, which backed the smog-check version of SB 435, motorcycles account for less than 1% of vehicle-miles traveled in the state yet account for 10% of passenger vehicles' smog-forming emissions; swapping a compliant tailpipe equipped with a catalytic converter for one without emissions controls can emit as many as 10 times more smog-forming pollutants per mile."

Call me a nanny-stater if you must, but I am in favor of this regulation. Motorcycle tailpipe volume, IMHO, has gotten to the point where it disturbs the public peace. I've heard motorcycles that have physically hurt my ear drums they are so loud. Not to mention the disturbance they cause at night when people are asleep. I'm not against all aftermarket exhausts... but there has to be a limit!

I agree that it should apply to cars and motorcycles, though from my experience there are far more obnoxiously loud motorcycles out there than cars.

i understand that motorcycles being noisier than cars adds is added safety for those choosing to roll on 2 wheels rather than four, but i've heard some bikes that are so over the top loud that the owner should be cited. i'm anti big brother as well, but when my hearing is at stake, something needs to be done.

LOL there are already laws agians't modified exhaust for all vehicles, why put another law in the books when they can enforce the ones that are already in place. the way I read it is it will only affect bikes being sold in and after 2013, that makes no sense.

I don't know about new legislation, whether this is the way to go or not, but I do hate it when I'm staying at a hotel and have finally fallen asleep (hard to sleep someplace other than my own bed) and a super loud motorcycle drives by and wakes me up. Not only that, but I can hear it for like a mile down the road!
