[SIZE=3]I have the same situation as several others and need clarification on my 2nd Tier EUC benefits. I am on my 2nd Extension which began Oct 21, 2012. I was notified Oct 31, 2012 that I was eligible for the 2nd Extension, and that it had already been filed for me. Great. Then I received the letter explaining that the EUC benefits would end on Dec 29, 2012, but that possibly claimants may receive payments for all weeks not worked though December 2012, which would give me one more check on December 21, 2013 one last one in January 2013. Then on Nov 27, 2012, I receive a notice “1277” that stated the claim I filed was not valid because I did not work during Year 2012, and that if I wish to appeal this decision an “Appeal Form is enclosed for my use, and to mail the form within 20 days, but also that this decision would not affect my current EUC benefits. As I have not filed any more claims since the original one, I now understand that a claim was automatically filed for me, once the original claim expired on Nov 26, 2012. [/SIZE]
[SIZE=3]Next I received another notice on Dec 5, 2012, a “Notice of Unemployment Insurance Award”, this time “stating a new beginning claim date of Nov 24, 2012” and an “ending claim date of Nov 23, 2013”, and that I had earnings in the quarters Sept 2011 and Dec 2011 from my old job, with two different amounts for each quarter. From the two quarters a middle amount was reached and used as the basis for a new weekly amount that I will receive. It went from $406 per week to $122 per week; maximum benefit $2865, (Please note, I last worked on 10/31/11, and did not file my claim until 12/2/11, and was giving a claim filing date of 11/26/11).[/SIZE]
[SIZE=3]Will the newly updated claim replace my 2nd tier EUC benefits, even though I still have a large cash amount left to be paid thru this year end and into FEB 2013, and will I start receiving the new lower amount instead? Also if Extended Benefits do get approved before the end of year by congress, or even if it gets approved next year, what happens to my 2nd Tier EUC benefits? My worry is losing the last two checks that I would have gotten for Dec 21 2012 and Jan 4, 2013 at $812 each, to possibly receiving the new lower amounts $244 each check (for 2 weeks combined). This would be devasting for my year end and new year. What I had hoped was that my 2ndTier EUC benefits would have continued until they exhausted at the end of Feb 2013. With the lower amount I will be shipwrecked, as I have not found employment yet and am desperately looking. Please advise. Thanks.[/SIZE]

I have the same issue with this but I replied before 20 days and now i have a hearing date but i still receiving my checks. it very confused to me
