Hey people,
I really need help. My landlord left a bunch of stuff in our place and refuses to move it. Whats the law? Can I break the lease? There is no specific language about her stuff in our lease agreement.

There is no law that I'm aware of... unless the items left behind are toxic or hazardous.

It depends on your agreement as to what is and isn't included...

Many of my residents do not have cars and I can offer reduced rent if the garage isn't included... I use one garage for items needed to maintain the property... such as ladders, tarps, garden tools and such and another I rent as a garage to a person with a classic car.

If the owner breached the lease and is unwilling to cure said breach and the breach is material... that sure sounds like it may be sufficient

Good Luck and you may want to have a lawyer review the lease if moving is the plan.

As you are in CA, you probably have more rights than does your landlord...
I'm with MikeEtc and want to know, what is the stuff and where is it? If the landlady took the stuff away, you'd be happy with the rental and want to stay?

Have you tried notifying her in writing that if she does not remove the stuff, you will consider that it is yours? Of course this tactic would depend on what kind of stuff it is....I understand that you just want it gone.

I would think that violates the quiet enjoyment clause in your lease. You can try the Renting forum for more specific advice.
