Permanent residency question, please help
Hi to all,
Me and my boyfreind, we are both graduate students in the US, we have both finished an MBA. He has just got accepted to get a canadiam PR. H did his medical tests. but he still did not stamp his passport. He was told that he has between 3 to 6 months to finish the whole process and be able to move to Canada.
We want to get married and move there together.
We would like to know what is better for us and faster. To file for me now with him, or to wait until his passport is stamped.
Please help. ASAP. we do not have much time to waste.
thank you

Okay, so the short version is that your boyfriend has applied for Permanent Resident's status in Canada and been accepted. However, he has not yet officially entered the country (gotten his passport stamped) to take up residence.
Regardless if you are boyfriend/girlfriend or married, you do not have PR status in Canada and therefore do have the legal right to enter Canada with the intention of living here. You could enter Canada as a visitor, but the expectation is that you would leave Canada to resume your residency in yur country of citizenship. There is no guarantee that Border Services would allow you to enter the country as a visitor.
As far as you attaining Permanent Resident's status, you will need to file an application on your own behalf. There is no provision for you to be piggy-backed on your boyfriend's application. You have a far greater chance of being approved if the 2 of you are married at the time of your application and your then husband acts as your sponsor.
You will still need to meet all the application criteria, provide the background checks, have the medical checks, and pay the appropriate fees. Your application will still take months to review. There will be no guarantee of acceptance.
If you are in Canada while your application is being processed, be aware that you will not be able to legally work, nor will you be eligible for government health insurance.

Thank you for your answer dear.
I am aware of what you are telling me.
What I want to know is that if he files for me as his wife now before his visa is stamped, how long does it take for both of us to get our visa and be able to move there.
Thank you

Your welcome.
Perhaps I didn't explain well enough.
Your boyfriend/husband has a Permanent Resident "visa" if he lands (gets his passport stamped at a port of entry) within the allocated amount of time. He won't actually get credited with having PR status until he enters Canada (gets his passport stamped). He can't sponsor you as a spouse until after he has entered Canada and attained PR status.
Unless you qualify for another type of visa, (work, student, etc), you will only be able to enter Canada as a vistor. As a visitor, one of the conditions of entry is that you return to your country of citizenship when your visit is over. You, as a visitor, are not entitled to stay and set up housekeeping.
Spousal sponsorships can either be done from abroad or from within Canada.
The application fees and processes are roughly equal. The wait times may vary depending on which immigration center processes your application. Current wait times for various centers are available on the Citizenship and Immigration Canada web site.
The advantage to you entering Canada as a visitor and applying for your PR status from inside Canada is that you would be able to live with your husband. The disadvantages would be that you be unable to work, attend school, or be eligible for government health coverage. Also keep in mind that if the Immigration department finds you fraudulently entered Canada as a visitor with the intention of staying, your PR aplication could be denied and you could be deported.
The advantages to you staying in your country of residence until your PR application is approved is that you would be entitled to work, study, etc.. The disadvantage, of course, is that you would seperated from your husband. This could be partially solved by you visiting him in Canada and him visiting you in your country of residence.
Regardless of where you apply for PR status from, your wait time will be at least 12 months after your application is submitted. Keep in mind that it also takes a certain amount of time to get all the application material together.

If you've received an acknowledgement from CIC that they are processing your application, you should also have been issued a client number.
You can check the status of application online through that client number. You can also check processing times at various processing centers.
Welcome Page | Page d'accueil
Your application has been in the system for only 2 months. It isn't realistic to expect an application to be approved in that short amount of time. Your wait could be 12 months or more.

The CIC web site has the information on processing times for London. It varies and I don't think everyone's experience is the same. your best bet would be to see what the information on their web site as a guide.

Hello:
I have been requested to perform my medical examinations and to send my passport in order to stamp the PR visa 2 months ago. I already sent the whole package including landing fee 5 weeks ago but I haven't received yet my passport back.
3 weeks after submitting the package, my girlfriend and I decided to get married outside my citizenship country and we did (a civil marriage). I wrote immigration services to see what they recommended but I have no answer at all. Therefore we proceded and got married.
In my email to Immigration services I explained them my intentions, but I also told them that we (my girlfriend and I) didn't intend to receive a PR status for both of us, but we wanted to perform a sponsor application after I would got stamped my passport
There is any possible consequence of acting this way regarding processing time or perhaps denying me the PR visa?
Please let me know as soon as possible with any recommendation you might provide us
Regards
