I got a job in US in December 2005 in USA.

Since then I pretty much lived in US except for a few visit to Canada to visit the family.

My wife was working in Canada and gave up the job in May 2006 to move to USA.Then we waited to finish my kids school till june to move.

We moved in june, but had to go back for a few week to sell the house.
I sold my house in October.

My accountant in USA says that I can claim Non-residency status in the entire year 2006 and won't have to pay canadian taxes.

But when I read in the canadian government website, it says that you are a resident if your family was in canada and have to pay canadian taxes.

Which is my correct date of non residency in canada?
Did anyone had similiar experience?

If you've read the Canada Revenue Agency's site or one of their booklets, you know there are several types of CRA residency for tax purposes. You also know that navigating this minefield is a confusing exercise.


While your US-based accountant may be perfectly correct for your situation, why not consult directly with the people who write the Canadian tax regulations?


The CRA has an International Tax Services Office in Ottawa. It has a toll-free telephone number which is manned from 8:15 am to 9 pm EDT.

Calling them and explaining your exact situation should get you a resolution directly from the Canadian government office involved with no middleman.
