The treating physician is retiring end of January. This is many months before the SOL. Can this retired doctor still refer the patient to another doctor. Can this retired doctor still be deposed or can he decline if his license is void the day he retires? Thanks.

Your doctor will still have their medical license even if they retire. Yes, they can refer you to another doctor. Yes, they can be deposed.
OP, is this doctor treating you for injuries under the medical coverage provided by your auto insurance policy? I'm wondering whether you've posted in the correct forum.
If this is in regard to treatment following an auto accident, the doctor can be called to testify in a deposition or at trial regardless of whether he is still licensed. (I am a paralegal and worked on thousands of injury cases over 25+ years.) Although he may be called to testify as a witness to your condition, it's possible he will no longer have the medical records to refresh his memory. Copies of all records should be obtained asap and preserved in case they are needed in the future. When the doctor is called to testify, he can verify that the records were generated by him and/or his office staff.

Not being covered by my auto insurance company. Yes auto accident injury.
All records for dates when this doctor saw the patient will be available and be acquired before he retires.
