A lot of people do that all the time. There are apps that suspicious ''significant others" install on their partner's cellphone that allows them to see every email or text the person sends. The data can be used in divorce procedures and such.

Though if I had enough distrust of my spouse to go stealthily installing snooping apps on his/her phone, I'd probably just save everyone the trouble and get a divorce.
As someone who was once stalked by an ex, I can tell you that such behavior is crazy.

Go to: Settings --> Privacy --> Location Services --> System Services (scroll to bottom) --> Frequent Locations (That's what you would turn off)
If you take a look at your history, you can see where you've been. For instance, I went to the doctor on Saturday, and it told me that I was there from 1:22pm to 2:58pm. Isn't this creepy? This could be a great way to track your kids.
Nope. Not creepy. It's an electronic device that has GPS. Your car probably knows where you've been, too.
