Not to sound rude but the OP sounds like one of those friends who talk ill about their mate, ask for advice over and over again but end up doing the exact opposite of what everyone suggest.

She already says she is going to give up and stay with the guy. He drives her car, spends her money and hasn't worked in 3 years.

Now, unless this guy was hit over the head with a brick and forgot who he was 3 years ago he has always been a bum.

If the OP wants out she can get out... but I'm pretty sure she really loves the guy and this is why she will stay with him.

If he is abusive and she fears for her life then it's a little different but either way she can leave. The way she describes him it sounds like he would be too lazy to try to find her anyway.

Maybe you 2 can put your heads and resources together and resolve both your situations. Do your research regarding the law and make sure it's accurate.

You should check with your local Law Enforcement. You could get a Restraining Order which would bar him from the house. Of course you need to show cause, in this case Mental Abuse. If you can get a permenant Restraining Order, it will keep him away as you process your divorce papers. It has the added benefit of him paying child support and household expenses. No job? Too bad, go to jail or get one to make those support payments. Almost any county should have a Domestic Abuse agency in it..You can call them to find out what you can do..

This is America, he'll probably try to get assets in the divorce and a lawyer will use psychological abuse or something to do it.. Freeloader nation.. Otherwise you could just file papers one afternoon and after he signs use legal clause to boot him..

P.S. I have relatives who were given free real estate and still don't have jobs in their 30s(years later) but manage to hang out at bars all week and keep having relatives pay their taxes.. Doesn't this just make you want to work extra hours and pay taxes?
