Does it go by county (we are in Union)? Also, we are putting a fence around the perimeter of the backyard...do we still need a fence around the pool too?

I claim ignorance of the rules about this. But I think a pool with a fence immediately around it would not be a lot of fun. OTOH, if little kids are a concern, then a fence would be a good idea. OTOH, if little kids are a concern, (tragic) accidents are always a possibility and a pool may not be a good idea.

Yeah, I know, that's too many hands.

The code for putting up a pool code fence ultimately decided by you municipal building department.
Most municipalities base their code on what is know as the Boca Pool Code which can be found at [url=http://en.wikipedia.org/wiki/Pool_fence]Pool fence - Wikipedia, the free encyclopedia[/url] Mod Cut will the styles of fence that meet pool code. So the best course of action to ensure compliance is to consult with you municipal building department, they should be able to provide you with the guidelines.

There will be very specific regulations on what is required. Your pool company can probably tell you what you will need. However, I would suggest you double check with your city and county building inspection departments to make 100% sure you will be in compliance.

I understand what you are saying about the pool around the fence. That's a child proof fence. It's a good idea if you have small children. It was a requirement when we lived in Florida, but I have never seen one in NC. We have been here for four years. The last house that we lived in (we rented) had a pool and just had a six foot privacy fence around the perimeter of the yard.

In addition I would call my insurance agent and inquire about the liabilty clauses on the homeowner's policy. The law is one thing...your coverage might be another problem.
