Does anyone know if it's illegal to record a conversation without the person finding out until the end when you would say "I just recorded this call?"

TIA for replies!

I will see what i can find out for you as far as NC laws, but first off - let me caution you that if it is across state lines (LD phone call) other laws come into play.

I think you have to state at the first of the call that you are recording the other person, but I am not sure. In the end, are you looking for something that is court admissible??? Cause that puts things in yet another realm.

Here is a link that should help you:

COVERTLY RECORDING TELEPHONE CONVERSATIONS

In North Carolina it is permissable as long as one party agrees to it.

Sunny - I think that many states follow that rule. But maybe the OP can say he works for Homeland Security so anything goes!

The OP was asking in this forum so it is under the presumption that the OP is seeking information in regards to North Carolina not other states and some states do not allow any recording and some states require both parties to be informed.

What the federal goverment does under the Homeland Security is a different ball game.

Sunny - There is usually something about recording phone conversations in phone books, so since they are localized, there may be a statement in the front of them (usual location if I remember) that will apply to the OP's question.

I've always understood the law to be that one party needs to be aware of the recording... It's been used in some large splashy trials.

It most likely comes down to what you plan to use it for. :P

that is why most customer service calls preface by stating "this call may be recorded for training purposes"
