Crazy law in NC
Went to our homeowners meeting last night and there is always a CMPD Officer there. Did you guys know that juveniles have to commit at least 5 crimes before they are arrested and taken to the juvenile detention center. Other than murder or attempted murder.
He can break into your home and get caught and 3 of your neighbors and get caught...but they can't do anything except take them home to their parents until the 5th offense. This is ridiculous.
He also stated that most of these kids are the way they are because once the Police take them to their parents...they see how the parents are.
Also he said if we protect ourselves with force...we need to use the correct terminology to get off. You can't just say someone was breaking into my house and I hit them (adult or juvenile) with a baseball bat or shot them. The CMPD officer said that you need to say "I was in fear for my life" (& family if that applies). He said the DA & Judge will pretty much let you off. Thought that was nice for him to tell us that.
Luckily we have not had one single break in or larcery of a motor vehichle so far this year. Mostly dealing with intoxicated people Uptown (leaving the clubs late) hanging around our building. Even though the sidewalk is public...they can not sit down or hang around where they do not live. He said to always call 911 and have them remomed or arrested if they are intoxicated.

It blew us away that they have to commit 5 offenses before they can be arrested. That is crazy! Once they become an adult...that is a different story.

Yeah. They then only have to commit 4 offenses to be arrested
Why do criminals get the protection and victims get nothing???

They can get by with 4. They have to commit that 5th offense to be arrested. How crazy is that? Speaking of juveniles only.
They have more rights than we do seems like.

If your a teen, anything "criminal" should be "one strike your out". Not 4..lol
Misdemeanors yeah I can understand, 4 is still way to many, maybe like 1-2 warnings. 2 tops.
But criminal offenses, esp this day and age...4 warnings is just crazy.

I wonder how long that law has been on the books???? Sounds like one of those "old" school laws that never got updated. Crazy though...
Seems to be the problem with todays kids though...as todays society becomes more and more violent we continue with this "kinder-gentler" attitude.

So I guess if you say "I was in fear of my life" so that's why I bashed his head in, because the first time I hit him with the lead pipe, it didn't seem to do much, so I hit him in the head 25 more times - you have a legit excuse! Good to know! Anyone breaking into my house, probably won't survive to get to the "Second Warning" - nevermind time 4!

you go directly to jail for drugs, but the crimes that endanger safety or personal property take multiple offenses...makes no sense.
I'd much rather have someone go to jail for breaking in my house than for smoking a joint on the corner...

Sooooo agree. I have never felt particularly threatened by a doobie nearby, LOL.
This country handles crime in the strangest ways . . . druggies need help - rehab - and jail is NOT the place for them. Now those who manufacture it or distribute it - different story.
Pretty sad that juvvies can use the streets as training grounds so they have their crime techniques perfected by age 18 . . . and a get out of jail free card until then.
No wonder we continue to see these young thugs w/ 15 charges on a rap sheet. They have been at this for a very looooooooong time.
