It was an overdraft account that was attached to our joint checking account. It should have been closed when we closed the checking account, but it wasn't. He then and went and got a checking account in his name only and attached this overdraft account to it. He has since overdrafted and refuses to pay the balance. It will cost me more to sue him then it is to just pay it off. I was trying to offer a settlement or get my name off of the account since it was a debt incurred after the divorce. I've talked to at least 10 people on the phone/at the branch. I'm going to try the branch again. I could just wait and let him pay the monthly payments (which are running over 30 days), but that will take forever.

UNGirl - was it a bank error that allowed that overdraft account to remain open? Because . . . if it was . . . then you should in no way be liable in this.

This is HEINOUS. I am concerned that - w/ your name attached - even if he pays it off - if he is late, won't that affect your credit?

Your best bet is to take paperwork - including divorce decree - to a branch and speak to someone face to face. What a crock. This seems downright fraudulent to me. I AM SO SORRY. And - good luck.

That's how I caught the error. Got a collection call for him on something else (four years after the divorce)-luckily I'm not on that account.....so I pulled my credit report. As a former credit officer, I know the importance of my credit worthiness. That's when I found the account.....it didn't show up until after it went over 30. The good news is it's a relatively small balance ($500ish) and I was able to get them to officially close the account, but I still don't want to pay off his debt!!

We'll see what happens next week. Now I understand why my Mom insists on banking at the local hometown bank....it's starting to sound like a good idea.

Customer service is a rare commodity these days - in every industry! But w/banking . . . it is so crucial since it involves not only our money - but our credit!! I am so glad you knew what to do to get this stopped. Sure hope you get some cooperation.

Amazing what junk can still occur even years after a divorce!!!!

Too bad he didn't have money in it, could have closed it and bought a TV or some stouffers.

Dispute the item on your credit report. The call centers are often a mismosh of people working there. Write down everyones name and employee number if they can give it out. This creates some accountablity.
