Fortunately Asheville leaders have at least show the wisdom (a very rare occurrence) to ban the creation of any future gated communities, which would help if you were located here.

The Board has been turned over to the community. But the builder still has to sell lots. And they have talked to the builder and compromised that the gates would be open during their sales operating hours. Hence, their goes our costly security!
So the builder has the majority or close to it because of the unsold lots.

please read my very first post. Clearly states where i need to know the laws- north carolina.

Threesons, here is Chapter 47F of NC statutes (aka The Planned Communities Act). It includes modifications that were included as a result of House Bill 1541 / S.L. 2005-422 - Homeowners Association Amendments - an act that modified language in Chapter 47F/Planned Communities act to provide greater protections for Homeowners.
