You location is listed as Nassau, New York. Shouldn't you be posting this in a a NY tread where people familiar with the laws governing HOAs might offer some suggestions based on NY laws.
Fortunately Asheville leaders have at least show the wisdom (a very rare occurrence) to ban the creation of any future gated communities, which would help if you were located here.

The Board has been turned over to the community. But the builder still has to sell lots. And they have talked to the builder and compromised that the gates would be open during their sales operating hours. Hence, their goes our costly security!
So the builder has the majority or close to it because of the unsold lots.
