First of all, HR may have no clue what is going on. The supervisor may be screwing around w/ scheduling and hours and job descriptions. He may have been approved for x amount of part time employees, for example, but is actually working them like full time employees. Yes, they may be trying to avoid bennies . . .

What I am saying is . . . HR may not approve of what the supervisor is doing and indeed, may not realize what he is doing.

Maybe a call to HR to ask politely about an explanation of full time vs. part time . . . and for a copy of the handbook - would be the logical first step. ???

he was told the company didn't give out handbooks. We're going to call HR and record the phone call just to cover our butts since NC is an at will state and employees basically have no rights.

I thought you said his supervisor said they "don't give out handbooks." His supervisor may be an a$$. Did he ask for a handbook from someone in HR?

You see . . . here is the catch. If a company has written policies, then by law, they have to follow them. If they do NOT have written policies, then they have a lot more leeway. So either they have a "handbook" (written policies) or they don't . . . and if they do . . . all employees must be given the opportunity to at least peruse the policies. Some companies only do this during orientation and indeed, do not let employees have their own copy of the handbook. But if they refer to company "policy," then . . . employees have the right to at least READ those policies.
