I wanted to get clarification of exactly what is considered wetlands and what is done to "protect" them? Also, if a builder has prior knowledge of wetlands within a neighborhood before construction begins, does this need to be disclosed? Specifically, if a potential buyer questions the sales rep, do they need to tell the buyer the truth? Common knowledge tells me yes, but if not required of course they won't. TIA for any info.

If it is a material fact about the property you are purchasing it is supposed to be disclosed. If it is not a material fact about the property but you ask the sellers agent a direct question and he/she knows the answer, he is supposed to answer you truthfully. Though I cannot speak for other agents, as a realtor this is not something I would mess around with. I like my job and really do not want to spend any time in real estate jail...

The county should have maps identifying wetlands. If you go on some of the county websites and get into their Planning Dept areas, you can probably access some of the mapping programs.

If you ask the builder specifically he should answer truthfully. However, that is just one example of why it is best to have a Buyer's Agent when you go to a builder or an onsite agent for new construction. Your Agent can answer your questions or find out the answers for you. Your agent works on your behalf; the onsite agent works for the builder.
