I do not understand...either they are in an HOA or they aren't. You can't just op out of it if your home is part of one.

Are you saying part of Curtis Pond does not have an HOA, or that it does but that some people aren't paying their dues?

I don't live in Curtis Pond, maybe someone who does can confirm this with more current info...I was told about a year & a half ago, by someone who does live in CP, that the residents of Phases 2,3 & 4 were given an option to join the HOA or not (Phase 1 homes are seperate from the rest of CP with their own HOA). Maybe this is what soldout is referring to Loves

That's kind of what I thought might be happening.

Some people don't realize that it is the developer of a piece of property that sets up the HOA, or doesn't set one up.

If a phase of a neighborhood is not in an HOA section sometimes there is an option you can join, it's just not mandatory that you do.

Frankly, I do not understand what soldout is so upset about.

If a homeowner is not in the HOA and does not disclose that to a buyer, the buyer and his agent would still find that out as such information would have to be part of the closing.
