I have a clean record and got gunned going 86 in a 70 in Rockbridge County this weekend. I had sped up to get around a truck that had stuff precariously attached to it that was making me concerned.

I am aware that this is a Class 1 misdemeanor. Do I need a lawyer, or should I try to get this reduced to speeding by myself? It is reasonable to think that this can happen?

Thanks guys, hopefully you can make a lousy weekend a bit better.

You might try contacting the DA in that county and see if they will reduce it or allow you to go to driving school.

Are you from out of state?

I am in state but I am several hours from the court in which I am scheduled to appear.

As someone who's been in the same place... I'll suggest you go ahead and appear in court with your most humble demeanor, accepting you made an error of judgment. With a clean record, chances are good that you'll get probation before judgement.

I just went through the same process last year, here in MD. The judge doesn't want to hear an excuse (mine was nearly identical to yours), he/she mostly wants to get smoothly through the "basic offenses" docket, so they can focus on the tougher/dangerous offenders.

Probation... for 86/70? If that's a likelihood, lawyer up. You DO NOT want a class 1 misdemeanor reckless driving. God virginia sucks in this regard (I went through the same thing, spent over 1K on a lawyer and the fine after getting my 77/55 on the beltway reduced to just a regular ticket).

This is VA. No such thing as probation before judgement.

OP. If you can afford an attorney it wouldn't hurt to get one. They may be able to handle it without you being there but each court system handles this how they want. If this attorney can get it reduced without you being there it might be worth it for you.
