I was divorced in April of 2008. I had no more money to fight. I had no choice to agree on everything. My ex kept the house, 401K, his $40,000.00 Mustang (1969), and of course a million dollar inheritance from his parents. I got $7,000.00 out of the marriage. $5,000.00 went to my lawyer and the other 2 grand went for taxes. He makes 70,000.00 per year and gives me 1,100.00 for 2 kids. I have them 90% of the time. I buy everything they need. He does nothing extra for them. He had in the decree that he is to claim the kids every year.......which is bull$hit I know! I want to add that into the motion too. If I can claim them I will get $2700.00 back, and if not I have to pay $550.00. Last year I could barely make it. I had to claim 9 on my taxes so I could receive as much money as I could. I work a full time job, and part time job delivering pizza. Please help if you can give me a sample letter on how to write it without hiring a lawyer. I can't afford a lawyer!! The one that I had in my divorce was just awful....I know I can do this myself.....I just need a guide or a sample of how it is to be worded properly!! Thank you!!!

Definitely PM Manigault.

FWIW, that sounds about right as to what you're getting for child support. It's 28% of net pay for two kids in the state of IL, I think. I pay my ex 20%, and I'm required to provide her with my W2 every year so she can update my amount paid.

Why would your ex keep everything? What was the point of paying a lawyer for that?

If Manigault can assist you that would be great.

I was divorced last year and did it pro se. Was easy enough, but I did a lot of research before and during the process.

Did you call the child support agency? Child Support Services

You really need to be proactive in your case and research stuff as much as possible.

I believe at the Rolling Meadows courthouse, every Friday at a certain time, they have a lawyer available to answer questions for people who are doing their own paperwork, I would call and ask for info at your local county courthouse.

Just to caution you, most of the county clerks aren't thrilled with people who do their own legal stuff. I was dressed up in a suit, had 10 copies of everything, and was still treated rudely by most of the govt workers, in comparison with the women who came to court in flip-flops and jeans, but had a lawyer (not in the house at the time) and was treated with the utmost respect.
