I told this woman she cannot do this without going to court. She tells me not to threaten her and says she can do this since there was not a signed lease. A friend informed me that the apartment (upstairs of this lady's house) was illegal. Landlady wants to take me to small claims court. Can I countersue her for renting illegally?

You could also just pay your rent and that would solve the problem.

I need more information. If there was not a signed lease, it sounds to me like you are on a month-to-month tenancy. In such cases, either party can terminate the arrangement on 30 days' notice. Did she give you a 30-day notice to vacate? If that's the case, it sounds like she's probably within her rights, and in technical, legal terms, this is not the same thing as an "eviction".

(Disclaimer: This is how I understand the law. I'm not an attorney.)

An oral contract can be binding. But do you really want to live in such a situation where the owner is trying to evict you? You don't say why she's trying to evict you, but chances are you should just move.

So, is the OP refusing to pay rent?
If so, why?
Or, are you current on your rent and the lady just wants you out?

If you owe backrent or refuse to pay rent, I'd evict your as$ to.
