So my company is being sued up there in Cook County and the case has been going on for a year and a half. I live in a different state. Never been to court nor had an attorney, but when I check the Cook County Circuit Court record, the company suing me keeps getting a continuance. Well today, I looked and the last entry in the court record said "SUMMONS NOT SERVED BY SPECIAL PROCESS SERVER"

What does that mean????

You were not served with the summons...if you have not been served they can not take you to court. Keep hiding...

What this means is that sooner or later whomever is suing you in Cook County will serve your registered agent in the state where your company is located. Then you will have to address the suit's contentions. You'll need a lawyer in Cook County, so PM me for referrals.

That could mean many things, but what I want to know is just whose company is being sued?

Is this your company, as in, you own all stock? S-corp deal where you're the only person? LLP? LLC? LP?

Or were you just some random employee in a company that's being sued in Illinois?

If yes to the immediate "above", you might want to talk to a local attorney about avoiding extradition in your state. Getting legal advice is heavily advised Legal advice in the real world, not online.

OK, I'll pose the question: How does the Cook County court have jurisdiction over your out of state matter? Did your company do something here? Did you sign a contract acknowledging that Cook County would be the venue for court action? And remember, if your matter is not for a lot of money, you may be able to be served via mail.

Expect a summons. I kept missing a guy for service of process until I figured out where he would be every Tuesday. I served the dude on kidney dialysis!
