I'm human....it would be common sense to know what another person is thinking of when committing the topic at hand.

Many more things were told to us during The Sermon on the Mount.

Does this give man authority to make-up new sins wherever he sees a a shadow?

It is not a sin. If you had any other sort of muscle ache would god punish you for rubbing it? No. This is one of the stupidest things christians get hung up on.
