hi, i found this really nice rental on craigslist- they claimed they just closed on it the day they showed it to me, so upon further research , there property is still active in the mls listing, while there short sale is pending is it legal to rent this condo even though technically its not theirs just yet-

What site are you seeing it still active on? Check PPAR.com as that will be current. Often Zillow, Trulia, Realtor.com, etc type sites are not updated with the current info. Also check the county assessors site for the current ownership, though it usually takes a week or so after closing for that one to be updated.

Sounds like a scam. If they closed on it then it is technically theirs. If they said it is closed on but a short sale is pending then they contradicted themselves and you know it is a scam. You should be able to find out from the county the status. They are likely showing this 'unowned' rental to as many parties as possible to collect deposits before disappearing.

I've heard of scams on craigslist regarding rental homes. They will ask to do things by mail, such as you mail them the deposit and 1st months rent and they will mail you the keys. You will receive no keys and they do not own the house. The find the house info on the net. I know someone near me that almost fell victim to this. Be careful. If anything, you can call the realtor listed to verify.
