Default H.o.a

If you built a new home and signed the rules when you moved in and then people wanted to start an HOA. Do you have to be part of it or do you just follow the rules you moved in with and signed.Then when they get one going and you did not sign are you responsible for any dues or assements.

I think it would come down to how the people vote in your neighborhood. They just can't start the H.O.A. in a area that didn't have one to begin with without the consent of the Homeowners. But i do think that if a majority wants it and it passes you will ultimately required to pay the dues.

I know in the neighborhood i live in here in Savannah, GA...I know each phase is different. The oldest phase doesn't pay any H.O.A....they only pay a membership fee if they want to be able to use the amenities [recreation center, tennis and basketball courts and etc]. The 2nd phase pays the H.O.A. dues and actually has a fee they pay every 4mths to maintain the reservoir by their homes. The last phase only pays H.O.A. fees...i'm in the last phase. I really wish it wasn't like that....and I know that the next time i move....it will be into a house that i get built in an area where there's not association fee's or neighbor 50ft next to me.

I really don't care to be constrained by a committee....if i want to paint my house...let me....if i want colored lights instead of all white for Christmas....it should be my choice....and etc.....

Thanks for the replie.In my neighborhood there is nothing no pool no playground no nothing just houses.Don't know why we would be paying dues ya know.
