I am in the fourth year of a Chapter 13 and got permission from the trustee to buy a car because my old car needed $3,000 in repairs. No one at the trustee's office would tell me a payoff amount on my old car, but I checked my statement and it was $1,150. I sent them a check for $2,200 that I thought was going to payoff the car. I traded my old car in and they gave me $1,400 trade in value on the financing. But over a month later they contacted me and told me that the trustee's office would not give them title to the trade in because I owed $1,150. Then the trustee's office came back and said I couldn't trade it in they wanted me to sell to a third party. The dealer now wants the 1,400 they gave me for the trade in and take the car back. The dealer never verified the payoff either when I signed the contracts. My Chapter 13 attorneys are worthless and won't advise me. Should I fight it on the grounds they did not verify the payoff or am I obligated to pay the 1,400 trade in value? Had I known there was a payoff amount I would not have included any trade in in the financing. The dealer refuses to refinance to take the trade in out. I don't really have the money to pay the trade in value and pay the new car payment. Any advice?

create a login id and you will then have full access to your chapter 13 ledger
